Mobius provides carbon intelligence and analytics services that may be accessed through our website, integrated into other platforms, or delivered directly via secure APIs or other agreed channels. Users acknowledge that certain services may rely on integrations with third-party platforms authorised by the user or their organisation. Mobius is not responsible for the accuracy or availability of third-party data but applies appropriate security and processing safeguards when integrating with such sources.
4. User Registration and Information
To access certain features of the Site or Services, you may be required to register. You agree to provide accurate, current, and complete information during the registration process and to keep your login credentials secure. You are solely responsible for all activities that occur under your account.
5. User Conduct

7. Data Processing on Behalf of Customers
7.1 Mobius as Data Processor
For certain services—whether delivered through the Mobius platform or via secure off-platform mechanisms—Mobius may process personal data solely on behalf of and under the instructions of its customers. In such cases, Mobius acts as a data processor, and the customer remains the data controller under applicable data protection laws.
7.2 Instructions & Customer Responsibility
Mobius processes such data in accordance with its contractual obligations and solely for the purposes defined in the customer agreement. Customers are responsible for ensuring they have a lawful basis to share personal data with Mobius and for the accuracy and lawfulness of the data shared.
7.3 Security & Subprocessors
Mobius applies appropriate technical and organisational measures to safeguard personal data. Where Mobius engages subprocessors (e.g., cloud hosting or analytics providers), it ensures that these parties are bound by contractual obligations that meet equivalent data protection standards.
7.4 Data Processing Agreement
Where required by law or by customer request, Mobius will enter into a separate Data Processing Agreement (DPA) outlining roles, responsibilities, and safeguards related to data processing.
7A. Benchmarking, Cohorts & Aggregated Insights
7A.1 Mobius as Independent Data Controller
In certain cases, Mobius may act as an independent data controller when generating benchmarking reports, cohort analytics, and aggregated performance indices.
7A.2 What We Do
Mobius may aggregate and analyse submitted or system-integrated data to produce anonymised benchmarking outputs, cohort indices (e.g., by building type, sector, or geography), and carbon performance metrics. These services may be delivered via the platform, APIs, or secure data transfers. Where necessary, Mobius may briefly process pseudonymised or hashed identifiers to enable cohort creation but does not retain personally identifiable information for these purposes.
7A.3 Lawful Basis & Privacy-by-Design
These processing activities are grounded in Mobius’s legitimate interests in service optimisation, innovation, and industry decarbonisation. Processing is subject to internal safeguards, including Data Protection Impact Assessments (DPIAs) and Legitimate Interests Assessments (LIAs). Outputs are designed to be non-identifiable using methods such as aggregation, suppression, and pseudonymisation.
7A.4 Your Rights
You have the right to object to processing based on legitimate interests. If you wish to exercise this right, please contact us at privacy@mobiuscarbon.com. We will assess your objection in accordance with applicable data protection laws and cease processing where legally required.
8. Limitation of Liability
Mobius Inc. Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses arising out of or related to your use of the Site or Services.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.
